Please read these Terms of Service carefully before using TheSpaVista. These Terms form a legally binding agreement between you and TheSpaVista. By using the Platform, you confirm that you are at least 18 years old and agree to these Terms.
By accessing or using TheSpaVista at thespavista.com ("the Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms apply to all visitors, users, and spa owners who access or use TheSpaVista. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
TheSpaVista is an online directory and discovery platform that allows users to:
- Browse and search verified spa and wellness listings across Mumbai, Thane, and Navi Mumbai.
• View spa details including services, pricing, photos, hours, and location.
• Submit enquiries to spas via our chatbot widget or WhatsApp booking links.
• Submit reviews and ratings for spas they have visited.
TheSpaVista is not a booking agency, travel agent, or healthcare provider. We facilitate discovery and connection between users and spa businesses. We are not a party to any transaction, appointment, or service agreement between users and spas.
By using TheSpaVista, you agree not to:
- Submit false, misleading, or fraudulent information in reviews, contact forms, or enquiries.
• Use the Platform to spam, harass, or impersonate any person or business.
• Attempt to scrape, crawl, or extract data from the Platform in bulk without written permission.
• Interfere with or disrupt the Platform's servers, security, or infrastructure.
• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Post or transmit any content that is defamatory, obscene, abusive, or infringes on third-party rights.
• Use automated bots or scripts to submit enquiries or contact forms.
We reserve the right to remove any content and suspend or terminate any user who violates these Terms.
You may submit reviews and ratings for spas you have personally visited. By submitting a review, you agree that:
- Your review is honest, accurate, and based on your genuine personal experience.
• You will not submit reviews for spas you own, manage, or have a financial interest in.
• You will not submit fake, incentivised, or competitor-targeted reviews.
• Your review does not contain personal attacks, hate speech, or private information about individuals.
• You grant TheSpaVista a non-exclusive, royalty-free licence to display, edit, and moderate your review on the Platform.
TheSpaVista moderates all reviews before publishing. We reserve the right to reject or remove reviews that violate these guidelines without notice.
Spa owners who submit listings agree to the following:
- All information submitted (business name, address, services, pricing, photos) is accurate and up to date.
• You are authorised to represent the business you are listing.
• Listing photos do not infringe on any third-party copyright.
• You will promptly notify us of any material changes to your business (closure, change of address, etc.).
• Free listings are at TheSpaVista's discretion and may be removed at any time.
• Premium listings are subject to the subscription plan terms agreed upon at the time of upgrade.
TheSpaVista reserves the right to approve, reject, edit, or remove any listing that violates our guidelines or is found to be inaccurate.
TheSpaVista provides tools to help you connect with spas (WhatsApp links, chatbot enquiries, phone numbers). However:
- TheSpaVista does not process, confirm, or guarantee any booking or appointment.
• All appointments are arranged directly between you and the spa.
• TheSpaVista is not responsible for cancellations, no-shows, pricing disputes, or service quality.
• Prices displayed on listings are indicative and may not reflect current rates. Always confirm pricing with the spa directly before your visit.
• TheSpaVista does not handle any payments between users and spas.
The TheSpaVista Platform, including its design, logo, code, content, and branding ("TheSpaVista IP"), is owned by TheSpaVista and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works of TheSpaVista IP without express written permission.
User-submitted content: By submitting reviews, photos, or other content to TheSpaVista, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with operating the Platform.
Spa-submitted content: Spa owners retain ownership of their uploaded photos and business information but grant TheSpaVista a licence to display this content on the Platform.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. TheSpaVista does not warrant that:
- The Platform will be uninterrupted, error-free, or free of viruses.
• Spa listings are always accurate, complete, or current.
• Search results will match your specific requirements.
• Any spa service will meet your expectations.
Spa details including prices, services, hours, and photos are provided by spa owners. While we review listings before approval, we cannot guarantee their ongoing accuracy. Always confirm details with the spa directly before visiting.
To the maximum extent permitted by applicable law, TheSpaVista and its team members shall not be liable for:
- Any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• Loss of data, revenue, or profit.
• Any injury, illness, or harm arising from spa services booked through or discovered via the Platform.
• Disputes between users and spa businesses.
• Downtime, technical errors, or data loss on the Platform.
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed INR 1,000 (One Thousand Rupees).
Your use of TheSpaVista is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at thespavista.com/privacy to understand how we collect and use your information.
TheSpaVista may suspend or terminate your access to the Platform at any time, without notice, for:
- Violation of these Terms.
• Submission of fraudulent, harmful, or illegal content.
• Any activity that threatens the security or integrity of the Platform.
Spa owners whose listings are removed due to Terms violations will not receive a refund of any premium subscription fees paid.
You may stop using the Platform at any time. Sections of these Terms that by their nature should survive termination (including liability, intellectual property, and dispute resolution) will continue to apply.
These Terms are governed by the laws of India, specifically the laws of the state of Maharashtra. Any disputes arising from these Terms or your use of TheSpaVista shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
We encourage you to contact us first at support@thespavista.com before initiating any legal action. We will make a genuine effort to resolve disputes amicably.
